I. DMCA Copyright Notifications.

AMPLIFIRE respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). We take allegations of copyright infringement seriously and will investigate all claims to the best of our ability. If you believe your copyrighted work has been used on our platform without your permission, please notify our designated agent using the contact information below. Your notice must include the information specified in the DMCA.

How to Submit a Copyright Takedown Notice

To help us process your copyright takedown notice efficiently and take appropriate action, please follow these instructions:


What to Include in Your Notice

To be valid under the DMCA, your written notice must include the following:

  • Your signature: physical or electronic signature of the copyright owner or someone authorized to act on their behalf.
  • The copyrighted work: Clearly identify the copyrighted work you believe has been infringed. If your notice covers multiple works on our platform, a representative list is sufficient.
  • The infringing material: Tell us what material you believe is infringing your copyright and where to find it on our platform. Provide enough information so we can easily locate it.
  • Your contact information: Include your name, address, phone number, and email address so we can get in touch with you.
  • Good faith belief: Include a statement that you believe the use of the material is not authorized by the copyright owner, their agent, or the law.
  • Accuracy of information: Confirm that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf. You may be subject to penalties for perjury if this statement is false.


What Happens Next

Once we receive your complete notice, we will promptly investigate the matter. If we are able to remove or disable access to the specific material you identified as infringing, we will do so. However, due to the nature of our platform, it may be necessary to terminate the account of the user responsible for the infringement in order to prevent further unauthorized use of your copyrighted work. If this is the case, we will take steps to notify the user about the termination of their account.

Important Note: We can only accept copyright takedown notices through the process described above. 


II. DMCA Counter Notifications. 


Restoring Removed Content: How to Submit a Counter-Notice

If you believe your content was removed from our platform due to a mistake or misidentification in a copyright takedown notice, you can submit a counter-notice to have it restored.


What to Include in Your Counter-Notice

Your counter-notice must be in writing and include the following:

  • Your signature: A physical or electronic signature.
  • Identification of the removed material: Tell us what content was removed and where it was located on our platform before it was taken down.
  • Good faith belief: Include a statement that you believe the material was removed due to a mistake or misidentification. This statement must be made under penalty of perjury.
  • Your contact information and jurisdiction: In your counter-notice, please provide your full name, mailing address, and telephone number. Because AMPLIFIRE operates exclusively within the United States and is headquartered in Georgia, you consent to the jurisdiction of the Federal District Court for the district where you reside for any legal      action related to your counter-notice. If you reside outside of the United States, any legal action must be filed in the Federal District Court for the Northern District of Georgia. Furthermore, you agree to accept service of process from the person who submitted the original takedown notice or their authorized representative. 


What Happens Next

When we receive your counter-notice, we will forward a copy to the person who submitted the original takedown notice. We will also let them know that we plan to restore your content within 10 business days. We will then restore your content or service, usually within 10 to 14 business days, unless we receive notice that the original complainant has filed a lawsuit to prevent you from sharing the material.
